This Privacy Policy explains how Zealous Host, LLC collects, uses, discloses, and protects information when you visit our website (https://zealous.host), create an account, purchase a game server, or otherwise use our services (collectively, the "Service"). We provide our Service to customers around the world, and this Policy is written to address the rights of visitors and customers regardless of location, including specific rights available under the EU/UK General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA/CPRA).
By using the Service, you agree to the collection and use of information in accordance with this Policy. If you do not agree, please do not use the Service.
• Account Information: name, email address, username, and password when you register for an account;
• Billing Information: billing name, address, and payment details, which are collected and processed by our third-party payment processors, Stripe and PayPal (see Section 5);
• Support communications: information you provide when contacting support or live chat, including your name, email address, and the content of your messages;
• Server configuration data: any content, files, plugins, or configurations you upload to your Server ("Your Content," as defined in our Terms of Service).
• Usage data: pages visited, features used, timestamps, referring URLs, and similar interaction data;
• Device and log data: IP address, browser type, operating system, and device identifiers;
• Cookies and similar technologies: as described in Section 3 below.
Because we provide game server hosting, server files and server logs may also be processed as needed to operate the Service, provide support you request, investigate suspected abuse, or comply with legal obligations. Our Terms of Service describe in more detail when and why we may access Your Content on a Server.
We use cookies and similar tracking technologies for the following purposes:
• Analytics: to understand how visitors use our website (e.g., pages viewed, time on site, traffic sources) so we can improve the Service.
• Affiliate tracking: to attribute referrals to affiliate partners when a visitor arrives through an affiliate link, so we can track and pay affiliate commissions. These cookies may be set by us or by our affiliate network partners.
You can control or disable cookies through your browser settings; however, doing so may affect the functionality of the website. Where required by law (such as under the GDPR or the UK/EU ePrivacy rules), we will request your consent before setting non-essential cookies through a cookie banner or similar mechanism.
• Provide, operate, and maintain the Service, including provisioning and supporting your Server;
• Process payments and manage billing, subscriptions, and renewals;
• Respond to support requests and communicate with you about your account;
• Monitor for and prevent fraud, abuse, and violations of our Terms of Service;
• Analyze usage trends and improve our website and Service;
• Attribute referrals and pay commissions under our affiliate program;
• Comply with legal obligations and enforce our agreements.
We do not sell your personal information. We share information only in the following circumstances:
• Payment processors: we use Stripe and PayPal to process your payments and manage billing. When you make a payment, your payment details are collected and processed directly by Stripe or PayPal in accordance with their own privacy policies. We do not store your full payment card details ourselves.
• Intercom: we use Intercom to provide live chat support. If you are logged into the billing panel and start a live chat, your name and email address are shared with Intercom to facilitate the conversation.
• Infrastructure and hosting providers: to operate the servers and network infrastructure that power the Service.
These service providers are only permitted to use your information as necessary to provide their services to us and are subject to confidentiality obligations.
If you arrive at our website through an affiliate link, tracking information (such as a cookie identifier and referral source) may be shared with our affiliate network partner to attribute the referral and calculate commissions.
We may disclose information if required to do so by law, or in the good-faith belief that such action is necessary to comply with a legal obligation, protect the safety of any person, address fraud or security issues, or protect our rights or property.
If we are involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control of your personal information.
We are based in the United States, and information we collect may be stored and processed in the United States or other countries where our service providers operate. If you are located in the EU, UK, or other regions with data transfer restrictions, we take steps intended to ensure appropriate safeguards are in place for such transfers, such as standard contractual clauses, where applicable.
We retain personal information for as long as necessary to provide the Service, comply with our legal obligations (such as tax and accounting requirements), resolve disputes, and enforce our agreements. When you request account or data deletion through the billing panel, we will delete or anonymize your information, except where we are required or permitted to retain it, such as billing records needed for tax purposes or logs needed to investigate abuse.
If you are located in the European Economic Area or United Kingdom, you have the right to:
• Access the personal information we hold about you;
• Request correction of inaccurate or incomplete information;
• Request erasure of your personal information;
• Request restriction of, or object to, our processing of your information;
• Request portability of your information in a structured, machine-readable format;
• Withdraw consent at any time, where processing is based on consent;
• Lodge a complaint with your local data protection supervisory authority.
Our legal bases for processing your information include performance of a contract (providing the Service you signed up for), our legitimate interests (such as fraud prevention and service improvement), consent (such as for non-essential cookies), and compliance with legal obligations.
If you are a California resident, you have the right to:
• Know what personal information we have collected, used, disclosed, and (if applicable) sold about you;
• Delete personal information we have collected from you, subject to certain exceptions;
• Correct inaccurate personal information;
• Opt out of the sale or sharing of personal information (we do not sell personal information, though our use of affiliate and analytics cookies may be considered "sharing" under CCPA for cross-context behavioral advertising purposes);
• Non-discrimination for exercising any of these rights.
Regardless of location, you can access, update, or request deletion of your account information at any time through the billing panel in your account dashboard. For privacy requests that cannot be handled through the billing panel, you may contact us at support@zealous.host. We may need to verify your identity before fulfilling certain requests.
We implement reasonable administrative, technical, and physical safeguards designed to protect your information from unauthorized access, use, or disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
The Service is not directed to individuals under 13, and we do not knowingly collect personal information from anyone under 13. Individuals between the ages of 13 and 17 may use the Service only with the consent and direct supervision of a parent or legal guardian, as described in our Terms of Service; in that case, we collect the same categories of information described in Section 2 of this Policy from the account holder. If we become aware that we have collected personal information from someone under 13, or from a 13-to-17-year-old without appropriate parental or guardian consent, we will take steps to delete that information.
Our website may contain links to third-party websites or services, including affiliate partner sites, that are not operated by us. We are not responsible for the privacy practices of these third parties, and we encourage you to review their privacy policies.
We may update this Privacy Policy from time to time. Except for non-material changes, we will provide at least seven (7) days' advance notice of any material change by posting the updated Policy on our website and/or notifying you through the billing panel or by email prior to the change taking effect. Continued use of the Service after a change takes effect constitutes your acceptance of the revised Policy.
